Correct, Terms of Use. I would use that exact terminology throughout Thinkific.
I have drafted these for It’s Now You Pty Ltd, with Victorian law, your 48 hour change of mind refund, separate marketing consent, international students, minors, health education protections, intellectual property, community participation and Thinkific processing. Importantly, the 48 hour policy is expressly in addition to rights that cannot legally be excluded. That matters because Australian consumer guarantees cannot simply be displaced by a contractual refund policy, and Thinkific now specifically flags potential EU withdrawal rights. Thinkific Support
I would also turn on “Collect email marketing consent at checkout” in the screen you showed me. That gives you a clean, separate opt in rather than treating course purchase as newsletter consent, consistent with Australian direct marketing principles and Thinkific's GDPR guidance. OAIC

These Terms of Use govern your access to and use of the online courses, educational materials, websites, learning platform, discussions and related services offered by It’s Now You Pty Ltd, including educational content presented by Nathan Siles and the course Foundations of Health: Energy, Water and Light.
By creating an account, purchasing or enrolling in a course, or accessing our course materials, you agree to these Terms of Use.
1. About Us
The courses and educational services are provided by:
It’s Now You Pty Ltd

Australia
Email: [email protected]
References in these Terms to “It’s Now You”, “we”, “us” or “our” refer to It’s Now You Pty Ltd.
2. Educational Purpose
Our courses and materials are provided for general informational and educational purposes only.
Nathan Siles and representatives of It’s Now You are educators and are not acting as your physician, medical practitioner, psychologist, dietitian or other licensed healthcare professional unless expressly stated otherwise.
Participation in a course does not create a doctor patient, practitioner patient, therapist client or other professional healthcare relationship.
Information presented through our courses may discuss health, biology, mitochondria, light, circadian biology, sleep, water, nutrition, environmental exposures, exercise, temperature, lifestyle practices and related subjects. Some material may discuss emerging research, scientific hypotheses, theoretical models or areas where scientific understanding continues to develop.
Nothing in a course should be interpreted as individualized medical advice, diagnosis, treatment or a recommendation to discontinue or modify medical care.
3. Your Health and Personal Responsibility
You are responsible for decisions concerning your own health and wellbeing.
Before making significant changes to your diet, exercise, sleep, environmental exposures, medications, supplements, therapies or other health practices, you should seek appropriate advice from a qualified healthcare professional, particularly if you have a medical condition, are pregnant or breastfeeding, take medication, or have other circumstances requiring individualized care.
Never disregard professional medical advice or delay seeking medical care because of information contained in our courses.
If you experience symptoms that may constitute a medical emergency, seek appropriate emergency medical assistance.
Individual responses to lifestyle practices and health interventions vary. We do not guarantee any particular health, performance, longevity or other outcome from applying information contained in our courses.
4. Eligibility and Minors
You must be at least 18 years old to independently purchase a course or create an account with us.
A person under 18 may participate in educational content where permitted by law and with the knowledge, consent and appropriate supervision of a parent or legal guardian. The parent or legal guardian is responsible for determining whether the content is appropriate for the minor.
5. Accounts
You are responsible for maintaining the confidentiality and security of your account credentials.
Your account is for your personal use only. You may not share your login details or provide another person with access to paid course content through your account.
You are responsible for activity occurring through your account where that activity results from your failure to keep your credentials reasonably secure.
Please notify us promptly if you believe your account has been accessed without authorization.
6. Purchases and Payments
Course prices are displayed at the time of purchase.
Payments are processed through Thinkific and its applicable third party payment providers. Payment processing may therefore also be subject to the terms and privacy policies of those providers.
You agree to provide accurate and current billing information when making a purchase.
Where applicable, taxes may be added or collected in accordance with relevant law.
7. 48 Hour Change of Mind Refund
If you change your mind after purchasing a course, you may request a refund by contacting [email protected] within 48 hours of purchase.
Requests received after the 48 hour change of mind period will generally not qualify for a change of mind refund.
This policy does not limit or exclude any refund, remedy, consumer guarantee, withdrawal right or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable consumer protection legislation.
Where the law of your country or region provides mandatory cancellation, withdrawal or refund rights, those rights continue to apply.
Consumers located in the European Union, European Economic Area or another jurisdiction providing statutory withdrawal rights may have additional rights, including in some circumstances a statutory withdrawal period. Those rights may be affected where a consumer expressly requests immediate supply of digital content and acknowledges any applicable loss of a withdrawal right, as permitted by law.
8. Course Access
Course access is provided according to the access period and conditions displayed when you purchase or enroll in the relevant course.
We may update, improve, reorganize or replace course materials from time to time to maintain or improve the educational experience.
We will not intentionally remove material elements of a paid course in a manner that deprives purchasers of the substantial benefit of what they purchased, except where reasonably necessary for legal, safety, technical or other legitimate reasons.
9. Intellectual Property
Unless otherwise stated, all course content and materials are owned by or licensed to It’s Now You Pty Ltd and are protected by applicable intellectual property laws.
This includes videos, recordings, presentations, diagrams, illustrations, graphics, written material, course structures, quizzes, worksheets, downloadable resources, educational frameworks, branding and other materials.
Purchasing a course gives you a limited, personal, non exclusive, non transferable licence to access and use the course for your own educational purposes.
You may not, without prior written permission:
copy or substantially reproduce course materials;
record, screen capture or download content except where a download function is expressly provided;
share your account or paid materials with others;
republish course materials online;
sell, sublicense or commercially distribute course materials;
use course materials to create a competing course, training program or commercial educational product;
remove copyright, trademark or other proprietary notices; or
otherwise exploit our intellectual property for commercial purposes.
Reasonable personal notes taken while studying the course are, of course, permitted.
10. Discussions and Student Contributions
Our learning environment may allow students to participate in discussions, answer questions, complete quizzes or otherwise contribute content.
We encourage respectful, curious and constructive discussion.
You must not post content that is unlawful, threatening, abusive, defamatory, discriminatory, deliberately misleading, infringing, invasive of another person's privacy, commercially promotional without permission, or otherwise materially disruptive to the learning environment.
You remain responsible for content you choose to post.
You should not upload medical records, diagnostic reports, financial information, passwords or other unnecessary sensitive personal information to course discussions or other shared areas.
We may moderate or remove content and may restrict participation where reasonably necessary to protect students, the community, our intellectual property or the integrity of the learning environment.
11. Mitochondriacs and External Communities
Students may be invited to join the Mitochondriacs Facebook community or other external communities for continued learning and discussion.
Participation is optional.
These communities may be operated through third party platforms such as Facebook and may have their own rules, terms and privacy practices.
Comments or advice provided by other community members represent the views of those individuals and should not be treated as medical advice or as statements made or endorsed by It’s Now You Pty Ltd, Nathan Siles or the course unless expressly identified as such.
12. Third Party Resources and Links
Courses may contain links or references to third party websites, research papers, books, products, communities, practitioners, organizations or other resources.
These are provided for educational or informational convenience. Unless expressly stated, inclusion does not mean that we control or accept responsibility for the third party, its content, availability, privacy practices, products or services.
13. No Guarantee of Results
Education can inform decisions, but individual circumstances and outcomes differ.
We do not promise or guarantee improvements in health, disease outcomes, sleep, energy, performance, cognition, longevity, financial outcomes or any other specific result from completing a course or implementing information discussed within it.
Testimonials or examples, where provided, describe individual experiences and do not guarantee that another person will experience the same outcome.
14. Availability and Technology
We take reasonable steps to maintain access to our courses but cannot guarantee uninterrupted or error free access at all times.
Temporary interruptions may occur because of maintenance, internet or hosting failures, third party services, cybersecurity events, technical problems or circumstances beyond our reasonable control.
15. Suspension or Termination
We may suspend or terminate access where a user materially breaches these Terms of Use, unlawfully distributes course content, shares paid access, abuses other community members, engages in fraudulent activity or otherwise materially compromises the integrity or security of the course environment.
Where reasonably appropriate, we may provide an opportunity to correct a breach before terminating access.
Nothing in this section affects rights or remedies that cannot lawfully be excluded.
16. Liability
To the maximum extent permitted by law, It’s Now You Pty Ltd and its directors, officers, employees, contractors, educators and representatives are not liable for indirect, incidental, special or consequential loss arising from your use of the courses or reliance on educational information contained within them.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
Where our liability may lawfully be limited, it will be limited to the extent permitted by applicable law.
17. Privacy
Your use of our courses is also governed by our Privacy Policy.
Thinkific and other service providers used to deliver or process the course may separately process personal information in accordance with their own privacy policies.
18. Changes to These Terms
We may update these Terms of Use from time to time to reflect changes to our courses, technology, business practices or legal obligations.
The current version will be made available through the course platform with its effective date.
Where a change materially affects existing purchasers' rights, we will take reasonable steps to provide appropriate notice where required by law.
19. Governing Law
These Terms of Use are governed by the laws of Victoria, Australia, subject to any mandatory consumer protection rights that apply to you based on your location.
Nothing in these Terms is intended to prevent a consumer from exercising rights available under applicable law.
